## 1. Introduction & Acceptance of Terms

Welcome to BigJPG.AI ("BigJPG.AI" / "we" / "us" / "our"). BigJPG.AI is operated by Elke Hwang, an individual sole trader operating under the laws of the Hong Kong Special Administrative Region.

These Terms of Service ("Terms") govern your access to and use of our image upscaling services, including our browser-based image enlargement platform, available at https://bigjpg.ai (the "Service").

By creating an account, subscribing to any plan, purchasing a licence, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorised to enter into this agreement on behalf of yourself or any organisation you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

## 2. Service Description

### 2.1 What We Provide
BigJPG.AI provides an image upscaling platform that enables users to enlarge images to a higher resolution. The Service is a digital software-as-a-service (SaaS) product delivered via the internet and executed in your web browser.

### 2.2 How Processing Works
Image processing is performed locally in your browser using your device's own computing resources. Your images are not uploaded to, transmitted to, or stored on our servers. Processing speed and output quality therefore depend in part on your device and browser.

### 2.3 Nature of the Service
The Service is a digital, intangible product. Upon confirmed payment, access to paid features is granted immediately. Because of this immediate digital delivery, specific limitations apply to refunds as described in Section 7.

### 2.4 Service Tiers
- Visitors (not signed in): limited number of upscales per browser, with a maximum enlargement factor below 8x. Outputs carry a "bigjpg.ai" watermark.
- Registered free users: upscaling at supported enlargement factors. Outputs carry a "bigjpg.ai" watermark.
- Paid subscribers and Lifetime licence holders: enlargement up to 16x, watermark-free exports, batch processing, and a commercial licence as described in Section 9.

Current tier limits and pricing are published at https://bigjpg.ai/#pricing. We may modify tier features or introduce new plans at any time; changes to the price of an existing subscription are governed by Section 5.

## 3. Account Registration & Eligibility

### 3.1 Account Creation
To use paid features you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

### 3.2 Account Security
- Notify us immediately of any unauthorised use at support@bigjpg.ai.
- Do not share your credentials with any third party.
- Keep your billing email address up to date.

### 3.3 Business Accounts
If you register on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

## 4. Plans & Pricing

We offer the following paid options. Current details and pricing are published at https://bigjpg.ai/#pricing.

- Pro (Monthly): a recurring subscription billed every month.
- Pro (Yearly): a recurring subscription billed every twelve (12) months.
- Lifetime: a single one-time purchase granting ongoing access to paid features, with no recurring charge.

All prices are stated in US Dollars (USD) unless otherwise displayed at checkout.

## 5. Billing & Payment

### 5.1 Recurring Billing Authorisation (Pro Monthly and Pro Yearly)
By providing your payment method and subscribing to a Pro Monthly or Pro Yearly plan, you expressly authorise us to charge your payment method on a recurring basis for the applicable subscription fee, at the interval shown at checkout (monthly or annually).

Your subscription renews automatically at the end of each billing period at the then-current price for your plan, unless cancelled in accordance with Section 6. This recurring authorisation remains in effect until you cancel.

We will send you advance notice by email before the renewal of any annual subscription. We will give you at least fourteen (14) days' notice by email before any increase in the price of your existing subscription takes effect; if you do not accept the new price, you may cancel before it applies.

### 5.2 One-Time Purchase Authorisation (Lifetime)
The Lifetime licence is a single, one-time transaction. By completing the purchase, you authorise us to charge your payment method for the amount displayed at checkout. The Lifetime licence does not auto-renew and generates no further charges.

"Lifetime" means for as long as BigJPG.AI continues to operate the Service. It does not create an obligation on us to operate the Service in perpetuity. If we permanently discontinue the Service, Section 13 applies.

### 5.3 Payment Processing and Billing Descriptor
Payments are processed by our third-party payment processors, Creem and Waffo Pancake. Depending on the checkout you used, the charge on your card or bank statement may appear as "CREEM.IO", "BIGJPG.AI", or a descriptor containing "PANCAKE". If you do not recognise a charge, please contact support@bigjpg.ai before disputing it with your bank — see Section 8.

### 5.4 Taxes
Prices are exclusive of applicable taxes (including VAT, GST, sales tax, or similar) unless otherwise stated at checkout. Where required by applicable law, such taxes will be collected and remitted by us or by our payment processor acting as merchant of record.

### 5.5 Failed Payments
If a recurring charge fails, we or our payment processor may retry the charge. If payment cannot be collected, access to paid features may be suspended until the outstanding amount is settled.

## 6. Cancellation Policy

### 6.1 How to Cancel
You may cancel a Pro Monthly or Pro Yearly subscription at any time through either of the following:
- In-product (recommended): sign in, open your Account menu, and select "Billing" to open the customer portal, where you can cancel your subscription, update your payment method, and view invoices.
- Email: send a cancellation request from your registered email address to support@bigjpg.ai.

Cancellation is effective as soon as it is submitted. A confirmation is issued by the customer portal immediately; if you cancel by email we will confirm within two (2) business days.

### 6.2 Effect of Cancellation
- Your subscription remains active until the end of the billing period you have already paid for.
- You will not be charged for any subsequent billing period.
- After the period ends, your account reverts to the free tier; exports will again carry a watermark and the commercial licence in Section 9.2 ends.
- Account data is retained for ninety (90) days after cancellation, then deleted in accordance with our Privacy Policy.

### 6.3 Lifetime Licences
The Lifetime licence is not a subscription and therefore cannot be "cancelled". Refund eligibility is governed by Section 7.

## 7. Refund Policy

### 7.1 General Policy
Because the Service is delivered digitally and access is granted immediately, fees are generally non-refundable, except as expressly stated in this Section 7 or as required by applicable law.

### 7.2 Eligible Refunds
- 7-day guarantee for first-time purchasers: if this is your first paid purchase of any BigJPG.AI plan (Pro Monthly, Pro Yearly, or Lifetime), you may request a full refund within seven (7) days of the initial charge.
- Duplicate charge: a full refund for any billing error resulting in a duplicate or incorrect charge, regardless of when it occurred.
- Verified service outage: if the Service is unavailable for seventy-two (72) consecutive hours or more due to a cause within our control, subscribers may request a pro-rated refund or account credit for the affected period.
- Statutory rights: where applicable law grants you a right of withdrawal or refund (for example, the 14-day withdrawal right available to consumers in the EU and UK), those rights are preserved and are not limited by this Section.

### 7.3 How to Request a Refund
Send your request to support@bigjpg.ai including your account email, the transaction ID or the date and amount of the charge, and the reason for the request. We will acknowledge within two (2) business days and, where the request is eligible, process the refund within five (5) to ten (10) business days. Refunds are returned to the original payment method; the time for funds to appear on your statement depends on your card issuer or bank.

### 7.4 Non-Refundable Items and Abuse
The following are not eligible for a refund:
- Subscription periods that have already elapsed, except as provided in Section 7.2.
- Requests made after the applicable window in Section 7.2 has closed.
- Second and subsequent purchases, where a refund has already been granted on a previous purchase by the same user.
- Accounts terminated for breach of these Terms or of the Acceptable Use Policy in Section 10.

We reserve the right to decline a refund request where there is evidence of abuse of the refund policy — for example, purchasing a plan, processing a large volume of images in a short period, and then requesting a refund; or repeated purchase-and-refund cycles across multiple accounts. Where we decline a request on this basis, we will tell you the reason.

## 8. Billing Disputes

If you believe a charge is incorrect, please contact us at support@bigjpg.ai **before** raising a dispute or chargeback with your bank. We commit to responding within two (2) business days and to resolving confirmed billing errors within five (5) business days. Most disputes are resolved faster and with less disruption to your account this way.

## 9. Your Content, Outputs & Intellectual Property

### 9.1 Ownership
You retain all rights in the images you supply to the Service ("Inputs"). The enlarged images produced by the Service ("Outputs") belong to you, subject to the licence terms below. You represent that you hold the necessary rights to every image you process.

Because processing takes place in your browser (Section 2.2), we do not receive, store, or acquire any licence over your Inputs or Outputs.

### 9.2 Commercial Licence
- Free tier (visitors and registered free users): Outputs may be used for personal, non-commercial purposes only — personal projects, non-commercial social media, and personal portfolios. Outputs carry a "bigjpg.ai" watermark, which you may not remove, obscure, or crop out.
- Paid tier (Pro subscribers and Lifetime licence holders): you receive watermark-free exports and a commercial licence covering digital downloads and sales, print-on-demand products, client and freelance work, e-commerce product imagery, marketing and advertising materials, and other commercial uses.

The commercial licence applies to Outputs created while your paid access was active, and survives cancellation for those Outputs. It does not extend to Outputs created after your paid access ends.

### 9.3 Our Intellectual Property
The Service, including its software, interface, and branding, remains our property. Nothing in these Terms transfers any right in the Service itself. You may not claim ownership of the BigJPG.AI technology or hold yourself out as its author.

### 9.4 Results May Vary
Upscaling enlarges an image; it cannot recover detail that is not present in the source file. Output quality depends on the resolution, compression, and characteristics of your original image. We do not guarantee any particular result for any particular image, and you are responsible for reviewing Outputs before relying on or publishing them.

## 10. Acceptable Use Policy

### 10.1 Permitted Uses
You may use the Service only for lawful purposes and in accordance with these Terms.

### 10.2 Prohibited Uses
You agree NOT to use the Service to:
- Process or distribute content that is illegal, defamatory, harassing, or fraudulent.
- Process content that sexualises minors or otherwise violates child protection laws.
- Process images you do not own or otherwise have the rights to use, or that infringe the intellectual property, privacy, or publicity rights of any third party.
- Produce or distribute imagery intended to impersonate a real individual or to deceive viewers about its origin or authenticity.
- Remove, obscure, or circumvent the watermark applied to free-tier Outputs.
- Circumvent usage limits, tier restrictions, or any security or access-control feature of the Service, including by creating multiple accounts to evade limits.
- Resell, sub-licence, rent, or white-label access to the Service itself without our prior written approval.
- Scrape, decompile, or reverse-engineer the Service, or use automated means to access it at a scale that degrades service for others.
- Violate any applicable law, regulation, or card network rule.

## 11. Data, Privacy & Security

Your use of the Service is governed by our Privacy Policy at https://bigjpg.ai/privacy-policy.

- Your images: processed locally in your browser and never uploaded to our servers (Section 2.2).
- Account data: we collect your email address and account details as necessary to provide the Service. Account data is retained for ninety (90) days following cancellation or deletion, then deleted.
- Payment data: card details are handled exclusively by our PCI-DSS compliant payment processors, Creem and Waffo Pancake. We never receive or store your full card number.
- Cookies: we use web cookies to operate the Service and to collect non-personal usage data for improving it.

## 12. Disclaimers & Limitation of Liability

### 12.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED AVAILABILITY, OR THE ACCURACY OR QUALITY OF ANY OUTPUT.

### 12.2 Output Disclaimer
⚠️ Upscaling cannot create detail that does not exist in your source image. Outputs may contain artefacts, softness, or other imperfections. You are solely responsible for inspecting Outputs before using them commercially, sending them to print, or delivering them to a client. We are not liable for printing costs, reprints, client losses, or other consequential costs arising from an Output that did not meet your expectations.

### 12.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, your statutory rights are not affected.

## 13. Term & Termination

### 13.1 Term
These Terms take effect when you first use the Service and remain in effect for as long as you use it or hold an account.

### 13.2 Termination by You
You may stop using the Service at any time. You may cancel a subscription under Section 6, and you may request deletion of your account at any time by emailing support@bigjpg.ai.

### 13.3 Suspension or Termination by Us — Breach
We may suspend or terminate your access to the Service, in whole or in part, with or without prior notice, if:
- you materially breach these Terms, including the Acceptable Use Policy in Section 10;
- we reasonably suspect fraudulent activity, payment fraud, or abuse of the refund policy;
- your payment method fails and the outstanding amount is not settled; or
- we are required to do so by law or by a payment network or regulator.

Where the breach is capable of being remedied and the circumstances allow, we will normally notify you and give you a reasonable opportunity to remedy it before terminating. For serious breaches — including processing content that sexualises minors, payment fraud, or attacks on the Service — we may terminate immediately and without notice.

### 13.4 Consequences of Termination for Breach
On termination for breach: your access ends immediately; any unused portion of a prepaid subscription or Lifetime licence is forfeited and is not refundable (Section 7.4); and the commercial licence in Section 9.2 terminates, meaning you must cease commercial use of Outputs created under that licence. You remain liable for any amounts already due, and for any loss or damage caused to us by the breach.

### 13.5 Termination Without Fault
If we terminate your account for a reason other than your breach, or if we permanently discontinue the Service, we will provide a pro-rated refund for any unused prepaid subscription period. Lifetime licence holders will receive a pro-rated refund calculated over the twelve (12) months following purchase; no refund is due where the Service has operated for more than twelve (12) months after your Lifetime purchase.

### 13.6 Survival
Sections 9 (ownership and our intellectual property), 12 (disclaimers and liability), 13.4, 14, and 15 survive termination.

## 14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. The courts of Hong Kong SAR have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

Before commencing any formal proceedings, please contact us at support@bigjpg.ai so that we can attempt to resolve the matter informally. We ask that you allow thirty (30) days for this.

If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your local courts, or that applies mandatory consumer protections, those rights are not affected by this Section.

## 15. General Provisions

- Changes to these Terms: we may update these Terms from time to time. We will notify you of material changes by email to your registered address, and by a notice on the Website, at least fourteen (14) days before they take effect. Continued use after the effective date constitutes acceptance. If you do not accept the change, you may cancel under Section 6.
- Severability: if any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions continue in full effect.
- No waiver: our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment: you may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of the business, on notice to you.
- Force majeure: we are not liable for failure or delay caused by events beyond our reasonable control.
- Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
